Learning objectives
Il corso persegue una pluralità di obiettivi. Il primo è quello di offrire agli studenti l'opportunità di studiare l'impatto, sia teorico sia pratico, di Internet sul fenomeno giuridico e su alcune norme ed istituti propri della scienza giuridica. Il secondo obiettivo è quello di fornire una completa panoramica della normativa europea in materia di reti e servizi di comunicazione elettronica, con particolare attenzione ai temi dell'accesso alla rete, della regolazione dei mercati, del servizio universale e della protezione dei dati elettronici. Infine, il terzo obiettivo è porre in luce le conseguenze costituzionali legate alla diffusione di Internet ed al cambiamento della percezione della rete da mero mezzo di comunicazione a strumento indispensabile per una molteplicità di attività.

Introduction. The legal definition of the information society. The constitutional background of the network. Internet as a means of communication. Internet as a requirement to act in the digital society. Freedom of expression in the ECHR and in the EU Charter of Fundamental Rights. Freedom of expression and freedom of communication in the Italian Constitution. The right to protection of electronic data. The freedom of economic initiative.

The European policy in the field of the electronic communications. The liberalization of the terminals, services and networks. The strategies of the services based competition and of the network based competition. The Framework 2002 and the Telecom Package 2009. The regulation of access. The pro competitive regulation. The asymmetric remedies. The procedure to impose asymmetric remedies. The social regulation. The universal service. Theconsumer protection rules in the communication field. The e-privacy directive.
