Il corso è dedicato all'approfondimento delle principali tematiche del diritto sindacale e delle relazioni industriali.
- Knowledge and understanding. The student must demonstrate to have acquired a basic understanding of trade unions right and the main way of industrial relations conduct. - application skill. The student must demonstrate to know how to apply the concepts learned in concrete contexts and specific cases concerning the right of association and industrial relations. - Making judgments. The student must demonstrate to know to take positions argued and legally sustainable with reference to the topics of the course. - communication skill. The student must demonstrate the ability to express the knowledge gained in consistent arguments and with systematic rigor and appropriate language. - Ability to learn. The student must demonstrate to know the historical patterns and evolution of the trade union law, applying the regulatory framework.
The course is dedicated to the deepening of the main themes of trade union rights and industrial relations. The following profiles will be treated in depth - through the analysis of case law, collective agreements and the intervention of qualified professionals (lawyers, judges, trade unionists, business leaders) -: collective bargaining with specific reference to the relationship between the national collective agreement and corporate contract; the evolution of collective bargaining and industrial relations in the last two decades; freedom of association and the trade unions tasks in companies; process of repression of the anti-union behavior; strike in its different ways of expression; role of bilateral bodies; corporate welfare. Particular attention will be paid to the relationship between theoretical profiles of the discipline and practical modalities of industrial relations. Due to the specificity of the topics covered is strongly recommended a constant frequency of classes.
Final exam For attending students, the exam will be in oral form on the basis of the judgments and the bibliographic material that will be announced by the beginning of the course and sent or shown before each lesson to the students via e-mail. For not attending students the exam will be held in oral form and knowledge in the following manual is required: M.V. Ballestrero, Diritto sindacale, Giappichelli, latest edition. Students are expected eventually to study also the material for the exam with direct consultation of normative sources of trade union rights and labor law. Among the many labor codes available on the market we recommend: MT Carinci (eds), Labour Code, Milan, Giuffrè, latest edition.
