Legal clinic on "identity politics and populist backlash"

Obiettivi formativi
The course aims to develop the knowledge of the Populist backlash from a legal point of view. Since the Great Recession of 2008, we witness a transformation of the constitutional values in many countries and a deep crisis of liberal democracies. Populist discourses typically problematize the gap between 'us', the people, and 'them', the corrupt establishment. Furthermore, in the demarcation of the people, national, ethnic, religious, and class identities are mobilized for political gains. Populists offer simple narratives which often rely heavily on identity politics, to reassure citizens in an increasingly global and interconnected world. The course will explore those issues from a comparative constitutional point of view; fostering a critical analysis and problem-solving, the students will be guided in the study of selected theoretical and practical cases and other legal issues.

At the end of the course, students will be able:
- to understand and analyze the main issues related to the Populist backlash from a theoretical and constitutional point of view
-to identify and to compare the different forms populisms and their relationship with the identities of the constitutional legal systems examined;
- to understand the growing interaction between different the populist backslash and the identity politics;
- to discuss the most controversial issues of the course through in-class discussion of case-law.

TTHE FOLLOWING VARIATIONS TO THE ORDINARY SYLLABUS WILL APPLY DURING THE CONTINUING COVID EMERGENCY
TEACHING METHODS
Classes of the courses offered by the LM in Sustainable Development will be delivered in distance learning modality. They will be live-streamed on Microsoft Teams, following the lessons timetable. All classes will be recorded and will be available on the online platform until the end of the semester.
Students will be informed as soon as possible, through the ARIEL website of the Course, if there will be a possibility to attend in person some classes at the University premises. This possibility will depend upon the evolution of the emergency and related safety measures, and the needs and preferences of students. In this case, students willing to attend classes will be required to reserve their seat through the LezioniUnimi app (unimi.it/en Home > study > bachelor-and-master-study > following-your-programme-of-study >. Strict compliance with the COVID protocol (facemask-wearing, social distancing, hands disinfection, etc ) will be required in the classrooms and all the University premises. In any case, all classes will be live-streamed and recorded and will be available on the online platform, in order to meet the needs of those unable or unwilling to attend in person.
The course will alternate and combine lectures and seminar teaching and will be tailored to match the learning necessities of students attending physically and remotely alike. Classes may require prior readings and include pre-recorded components.
To cope with possible connection and/or time zone issues, simultaneous course attendance (i.e. connection on the platform at the scheduled time) will not be mandatory. However, the Course will be based on class interaction. Therefore, students are strongly advised to strive to be able to attend the online classes.
SYLLABUS
The course programme is unchanged. However, the specific contents of classes will adapt to the teaching methods outlined above.
TEACHING RESOURCES
Reference materials for each class will be adjusted to the distance learning modality and uploaded to the Ariel course website.
ASSESSMENT METHODS AND CRITERIA
Learning verification and evaluation criteria are unchanged. Students will also be assessed on their contributions to in-class discussions. The final grade will be for each kind of exam: "Approved" (A) / "Not approved" (NA).

Programma
The class will focus on the following topics: a) populism from theoretical perspective; b) popular and populist constitutionalism; c) identity politics; d) sovranism and nationalism in Europe and US; e) identity politics and populism in comparative perspective
Prerequisiti
There are no specific prerequisites other than those required for access to the degree course.

Professor will use: a) lectures; b) thematic insights proposed to students (with particular regard to the analysis of comparative constitutional case-law); c) seminars

Modalità di verifica dell’apprendimento e criteri di valutazione
The evaluation will take into account, in addition to the acquisition of the contents of the teaching, the capacity for critical reasoning, the quality of the exposure, the competence in the use of the proper lexicon.
