Learning objectives
L'insegnamento, di carattere generale, è volto a fornire allo studente, attraverso il confronto, la conoscenza dei lineamenti caratterizzanti i grandi sistemi ove confluiscono gli ordinamenti giuridici oggi vigenti nel mondo.
L'insegnamento non offrirà la semplice illustrazione degli istituti e delle regole astratte di detti sistemi, bensì esaminerà i fattori che hanno contribuito a segnare le diverse tradizioni giuridiche; in particolare, verranno illustrati i modi di creazione della regola giuridica, il suo ruolo nella società, l'organizzazione ed il funzionamento della giustizia, la formazione del giurista, la sua influenza nell'evoluzione del diritto, ecc.

Course syllabus
The general teaching is aimed at providing the student, through interaction, with the knowledge of the features characterizing the modern legal systems.
Teaching will not merely illustrate the institutions and abstract rules of these systems, but will examine the factors that have contributed to the different legal traditions. In particular, it will explain ways of creating legal rules, their role in society, the organization and functioning of justice, the training of a lawyer, his/her influence on the evolution of law, etc..

The teaching, which includes classic face to face lessons, is characterized by a broad involvement of students, thanks to constant interaction and moments dedicated to sharing the main themes taught.

Assessment methods and Criteria
The exam is oral only. The student will initially be asked general questions and subsequently more detailed ones about the programme. Both knowledge of the programme and the ability to make comparative assessments of what has been learned will be assessed.
The average duration of the exam is about 15/20 minutes.

Second semester
Course syllabus
The course aims, first of all, at furnishing the basic knowledge of the discipline and of the method of legal comparison.
The lessons will then illustrate the main characteristics of the various legal traditions by describing both their historical evolution and their present features. In this regard, the following themes will be addressed: the common law model, highlighting, in particular, common and differential characters of the English and American legal systems; the civil law model; the legal system of the post-socialist states; the Islamic law; the legal systems of the Indian subcontinent, the Far East and Africa; the mixed legal systems. Special attention will be paid, moreover, to the factors that have contributed to the differences between the legal traditions, such as the ways in which legal rules are created, the organization and the functioning of the judiciary and the training of lawyers. Finally, the course will treat some transversal themes, such as the interactions between the different legal systems, the role of supranational institutions, the relationships between law and the new technologies.
Prerequisites for admission
Knowledge of the main institutes of public and private law.
