Learning objectives
Il corso ha lo scopo di far conseguire agli studenti:
- la conoscenza approfondita relative all'origine, alle fonti, alla struttura e al funzionamento del sistema prevenzionistico in Italia e in Europa in materia di salute e sicurezza dei luoghi di lavoro;
- la capacità di affrontare criticamente i temi e di risolvere le questioni giuridiche richieste ai fini dell'assunzione di compiti di natura tecnico-giuridica connessi allo svolgimento dell'attività aziendale e professionale e all'attuazione delle disposizioni del d.lgs. n. 81/2008;
- la piena padronanza del linguaggio tecnico attinente alla materia;
- la capacità di collegare i diversi argomenti e di applicare le conoscenze acquisite nell'interpretare le fonti di disciplina legislativa e contrattuale vigenti con metodo e autonomia di valutazione.
Expected learning outcomes
Al termine del corso, lo studente che abbia proficuamente appreso la materia avrà una conoscenza approfondita delle finalità, dei contesti, delle problematiche e delle possibili conseguenze delle politiche del diritto internazionale, europeo e nazionale in materia di salute e sicurezza dei lavoratori con l'acquisizione di un metodo di ragionamento idoneo ad affrontare temi giuridici complessi.

Course syllabus
The course will be divided into two modules:
a) a first module concerning the protection of the health and safety of workers in the national (constitutional principles, code of conduct, special legislation, Article 9 of the Workers' Statute, the evolution of company and national collective bargaining), international (the ILO Conventions, the framework directive n. 391/1989 and the particular directives, the case law of the Court of Justice) and EU (the limits and critical profiles in the implementation of EU directives in the main European countries);
b) a second module concerning the regulation of Title I of Legislative Decree no. 81/2008 and, in particular, the developments and characteristics of the regulation (also in the light of the digital transformation of "Industry 4.0"), the objective and subjective scope of application, the institutional and prevention system, the insurance system for accidents at work and occupational diseases.
Prerequisites for admission
No prior knowledge is required, with the exception of what is indicated in the teaching regulations of the degree course, according to which the teachings of institutions of private law, constitutional law and labour law are preparatory.
Teaching methods
Frontal lessons. The classroom lessons will be accompanied by seminars and in-depth studies dedicated to specific aspects of the subject.

Students, attending and not, are required to prepare the exam on the following texts:

b) S. Giubboni - G. Ludovico - A. Rossi, Infortuni sul lavoro e malattie professionali, Cedam, Padova, 2014, from page 131 to page 198.
Assessment methods and Criteria
The final proof of profit related to the teaching takes place in oral form and the evaluation is expressed with a mark in thirtieth, with possible praise. The oral test is aimed at ascertaining the degree of knowledge of the subject, the level of in-depth study and the quality of exposure.
Verifications in itinere of the profit can be made during the course in written or oral form for students who have regularly attended lessons in the classroom. The modalities will be indicated in the lesson and communicated on the ARIEL UNIMI platform in the section dedicated to teaching.
