Knowledge and Understanding The course aims to explore, according to a legal and institutional approach, the problem of human dignity, in the Italian legal system and under a comparative European and international perspective. The aim is to open students to a deep knowledge of the more relevant legal instruments and of the most important decision-making techniques adopted by the judges. First, the analysis will focus on the Italian legal system, the Italian Constitution and the constitutional jurisprudence. Particular attention will also be given to the European system, both to the European Union and the Charter of Fundamental Rights and to the Council of Europe and the European Convention on Human Rights and Fundamental Freedoms, under the perspective of the legislative texts and of the jurisprudence of the Courts of Luxembourg and Strasbourg. Particular attention is devoted to the international legal system and to some States which, in the comparative scenario, undoubtedly constitute a reference point. The Laboratory therefore intends to explore some of the most relevant and current problems of human dignity, in order to analyse also what may be their future developments.
Expected learning outcomes
Ability to apply knowledge and understanding. The aim of the course is to make the student able to apply the main concepts of contemporary constitutionalism concerning human dignity to problems, questions and cases arising in different contexts, but requiring an increasingly homogeneous background. Autonomy of judgment The course aims to make students capable to form an autonomous interpretation, from the legal point of view, of political, institutional and social events concerning human dignity. Communication skills The course aims to make students capable to illustrate, even to non-specialist interlocutors, the main concepts of contemporary constitutionalism applied to the theme of human dignity, with properties of language and expository clarity. Learning ability The course aims to provide students with knowledge and methodological skills related to the phenomenon of human dignity, also with a view to further study in the career.
