Complementary Course: "civil Liability and Insurance. Comparison of Civil Law and Common Law Models"

Learning objectives
The course aims to enable students to achieve: - the knowledge of the legal institutions analysed in the Italian legal system and in the other legal traditions that will be analysed. - the acquisition of a higher level of understanding of the "phenomenon" of civil liability and its interconnections with insurance.
Expected learning outcomes
The student must demonstrate that he/she has acquired a good knowledge of the legal institutions analysed and has understood the main features of the different legal traditions. The student must also demonstrate that he/she has acquired an awareness of the results achieved by comparative science with regard to the divergences and convergences of the main contemporary legal systems. The student must also demonstrate that he/she has acquired adequate analytical and argumentative skills on the cases and materials discussed in the classroom, through the use of precise and rigorous language and the correct use of legal categories.

The course aims to investigate the interrelationships between liability systems and insurance in order to identify a picture of the new frontiers of liability which has seen both its principles and its typical functions change. The module will consist of two parts. A first part will be devoted to exploring liability institutions in the main traditions of civil law and common law with particular attention to the role played by both voluntary and compulsory insurance, the dissemination of which has led to the emergence of a "new" liability that often goes beyond the subjective element of fault. A second part of the module will be dedicated to the analysis of cases and materials, aimed at bringing out the influence of insurance on the evolution of civil liability.

Prerequisites for admission
knowledge of English at least in text comprehension is required.
Teaching methods
There will be both lectures with analysis and discussion of cases and seminars during which the participation of students is required, even divided into working groups.

Assessment methods and Criteria
The granting of the 3CFU is subject to the attendance of 70% of the lessons (i.e. 7 lessons out of 10) to which active participation in the analysis and discussion of concrete cases is required.
