Learning objectives
The aim of the course is to provide students with the following competences:
A comprehensive understanding of the most important offences provided by Italian Criminal Law, selected on the basis of their practical relevance.
The knowledge of the most relevant case-law concerning both selected offences and general concepts cross-cutting different areas of Criminal law.
The ability to interpret provisions related to specific offences and to identify their fundamental relations with the so called "general part" of the Criminal Law.
The ability to properly handle the Italian Penal Code.
The abilities to address, discuss and solve both simple and more complicated practical cases in accordance with Italian Criminal Law.
The ability to understand and to use the appropriate legal terminology.
Expected learning outcomes
At the end of the course, students who have successfully learned the subject will have a strong knowledge of the special part of Italian Criminal Law, with reference to a catalogue of offences selected on the basis of their practical relevance, and to the related interpretative issues addressed in case-law and doctrine. In addition, they will have developed a method that will enable them, independently, to handle the Italian Criminal Code, identify and interpret the relevant rules for the solution of both simple and more complicated practical cases, as well as to develop and explain legal reasoning with appropriate terminology.

Course syllabus
The subject of this course is the study of a number of selected offences within the Italian Criminal code, dedicated to:
(i) Crimes against the person (in particular: against life, physical integrity, honour, individual physical and psychic freedom, sexual freedom).
(ii) Crimes against property (in particular: crimes consisting in unilateral aggression, crimes with the cooperation of the victim).
Knowledge of the general part of criminal law, with reference to constitutional principles (legality, harm and culpability) and the structure of criminal offences (actus reus, mens rea, justifications and excuses, attempt, participation, multiple offences, circumstances) is an integral part of the programme insofar as it is functional to the understanding of the special part issues dealt with.
PLEASE NOTE: in the event of passing the examination on the basis of this syllabus (which awards 6 CFU), it will not be possible to supplement the syllabus in order to obtain 9 CFU, with the exception of students on Sciences of legal services (3 years course) who are transferring to the Law Degree (5 years course)
Prerequisites for admission
According to art. 5 of the "Regolamento didattico del Corso di Laurea magistrale a ciclo unico in Giurisprudenza", it is mandatory to successfully pass the exams of Constitutional Law, Institutions of Private Law and Criminal Law (general part) before attending this course.
Teaching methods
The course is composed of lectures of three hours each and has a total duration of 42 hours. During the lectures, student participation will be constantly encouraged through the discussion of issues relating to the interpretation of criminal law provisions and the examination of practical cases.

The examination will cover the topics covered during lectures. Therefore, the reference materials will consist of the notes taken in class and the materials provided by the lecturer via the MyAriel platform.

- Criminal Code: an up-to-date Criminal Code in hard copy or pdf format is essential.
- For reviewing the general part, where necessary, the following textbook is recommended: G. Marinucci, E. Dolcini, G.L. Gatta, Manuale di diritto penale. Parte generale, 12th ed., Giuffrè, 2023.
Assessment methods and Criteria
The final exam consists of an oral interview aimed at ascertaining knowledge of the topics covered by the course programme, as well as the acquisition of adequate expository skills and the ability to rework the notions learnt. The ability to navigate through the provisions of the penal code and to articulate interpretative reasoning will also be assessed.
The assessment is expressed in thirtieths.
At the time of registration for the oral examination, it will be possible to express a preference for taking the test with the teacher in charge of the course.
There is no specific program for Erasmus students.
