Learning objectives
To acquire basic knowledge of the Italian legal system; to acquire fundamental tools for legal interpretation.
To acquire knowledge of the institutional actors operating in mountain areas, the rules governing them, their respective powers. To gain information about the main stages of evolution of Italian legislation concerning the mountains and about the legislation itself.
The course aims to provide information about relevant aspects of legislation regarding mountain areas and to develop methodological issues, in order to provide tools for the study and analysis of any legislation.
Expected learning outcomes
Background to Italian law and legal system;
Legislation between state regulations, regional regulations and European Union regulations;
Constitutional framework: art. 44, co. 2, Constitution and the "measures in favor of mountain areas"; constitutional principles;
Legislation regarding mountain areas between uniformity and specificity: the different phases of state legislation, the intervention of the Regions, the contribution of the European Union;
The legislative power of the State and of the Regions for the mountains: subjects and "policies";
The government of local institutions dealing with mountain areas;
Protection of the environment, agriculture, energy, tourism.

The sources of law, the order of the Republic and the division of powers;
The legal system between state norms, regional norms and European Union norms;
Constitutional framework: art. 44, co. 2, Const. and the "measures in favor of mountain areas"; Constitutional principles;
The regulation of mountain territory between uniformity and specificity: the different stages of state legislation, the intervention of the regions, the contribution of the European Union;
The legislative power of the state and regions for mountain areas: subjects and "policies";
Mountain local government;
Environmental protection, agriculture, energy, tourism;
Mountains as a cross-cutting priority in European planning and the PNRR: "a greener Europe, a more connected Europe";
The experience in Green Communities: an open construction site.
Prerequisites for admission
They constitute mandatory requirements for participation in the course:
- Be a 2nd year, 3rd year or out-of-school student of the Bachelor of Science in Environmental Enhancement and Protection of the Mountain Environment and Territory.
Assessment methods and Criteria
Documented course attendance and passing a final exam will allow the acquisition of 3 CFU. 75% of the scheduled hours must have been attended to access the final exam.
