Learning objectives
The course aims to provide students with:
- the knowledge of the main tools to combat organized crime: substantive criminal law tools (first of all, the crime of mafia-association - art. 416 bis c.p.), preventive tools (with particular attention to the prevention measures provided for by the so-called anti-mafia code), and administrative tools;
- an occasion for reflection on the concepts of legality, crime and its contrast.
Expected learning outcomes
At the end of the course, the student who has successfully learned the subject will have a thorough knowledge of the course topics, with the acquisition of a reasoning method suitable for dealing with legal issues relating to the fight against organized crime and to the prevention measures

- Introduzione. I significati della legalità
- "L'associazione di tipo mafioso" (art. 416 bis c.p.)
- L'aggravante del "metodo" e del "fine di agevolazione" mafiosi
- La figura del "partecipe" e il c.d. concorso esterno
- Il reato di scambio elettorale politico-mafioso (art. 416 ter c.p.)
- La responsabilità da reato degli enti (d.lgs. 231/2001) e la criminalità organizzata
- Le misure di prevenzione personali
- Le misure di prevenzione patrimoniali
- Strumenti di diritto amministrativo per il contrasto alla criminalità organizzata
- La c.d. interdittiva prefettizia
- Lo scioglimento dei consigli comunali "contaminati dalla mafia"
- Altri strumenti di diritto amministrativo destinati al contrasto della criminalità organizzata e alla prevenzione della corruzione
Prerequisites for admission
The exams of Istituzioni di diritto privato and of Diritto costituzionale are preparatory.
For law students, the course is reserved for those who have already taken the exam of Diritto penale. It is also preferable to have already taken the exam of Procedura penale and the exam of Diritto amministrativo.
Teaching methods
In addition to the lectures, the course will be enriched with some monothematic seminars, with external guests (judges, lawyers, civil society personalities), organized in collaboration with CROSS - Osservatorio della criminalità organizzata and with PhD Studies on organized crime.

Assessment methods and Criteria
The final exam will consist of an oral interview lasting about 30 minutes and will consistently focus on the various subjects dealt with by the Course (criminal law profiles, preventive measures, administrative law). Evaluations will be expressed in thirtieths.
