Learning objectives
The course of Environmental Law aims to provide students with the knowledge related to the legal system that supports and reaffirms the need to protect the environment as a primary good for life and therefore as a constitutionally protected value. The course, in particular, is aimed at deepening the following aspects: the international and Euro-unitary context of environmental law and its relevance in international balances also in relation to climate change; the constitutional framework as reformed with LC no. 3 of 2001 and LC no. 1 of 2022; The regime of sources that contribute to defining environmental law in its original and increasingly incisive transversality; the framework of competences resulting from the 2001 constitutional reform; The most relevant jurisprudential contributions; The principles defined in Legislative Decree no. 152 of 2006; the environmental procedures defined in Legislative Decree no. 152 of 2006; the instruments for the protection of natural resources provided for by Legislative Decree no. 152 of 2006 and other regulatory sources; The prospects for reform of Legislative Decree no. 152 of 2006. . The course is part of the educational objectives of the Master's Degree Course which aims to provide, among other things, a knowledge of environmental law that has become central to the policies and actions of the EU and its member states with a view to promoting sustainable development, also referred to in the PNRR. The knowledge that students want to acquire is used to develop skills consistent with the professional profiles and employment opportunities provided by the Master's Degree Course.
Expected learning outcomes
At the end of the course students must have developed: knowledge and understanding of issues related to the different aspects of environmental law; the ability to apply this knowledge and understanding, also through a personal and critical evaluation, the potential and criticalities of the legal framework of environmental law, both because of the multi-source regulatory complex, and for the economic and financial importance that environmental law has for today's society and its desired sustainable development; a mastery of the topics examined, through the use of adequate legal terminology and methodological and logical-argumentative rigor. methodological and logical-argumentative.
The final exam aims to verify the expected learning outcomes in relation to the ability to understand, knowledge, critical analysis of the interpretations and theoretical perspectives introduced by the Course.
