Employment Law in the Private Sector

Learning objectives
Combining face-to-face teaching and active learning (e.g., case analysis, exercises), the course aims to provide students with legal knowledge and application skills useful in approaching the management of employment relationships and work organization within the private health care sector with a greater awareness of the legal framework, including its concrete application. After a first module with an introductory approach, aimed at identifying the peculiarities of work in the sector and its implications with respect to the general structure of the law-collective bargaining relationship, we will focus on the different forms of employment in the sector (subordinate employment, self-employment, parasubordinate employment). We will focus, then, on the regulation of subordinate employment, first with reference to the individual employment relationship and organizational profiles (second module) and, then, with attention to the different employment contracts (third module), paying particular attention to the interaction between law and collective bargaining.
In particular, through the Course the students will be provided with:
- legal notions, methods and legal instruments related to the sources of regulation of employment relationships in the private health care sector;
- legal notions, methods and legal instruments related to the qualification of employment relations, with specific attention to industry practices;
- legal notions, methods and legal instruments related to labour law regulations that affect the organization of work in the sector, with specific reference to work performance (job descriptions), working time, remuneration, exercise of managerial prerogatives, obligations to protect the health of the worker, management of cases of suspension of the relationship;
- legal notions, methods and legal instruments related to employment contracts and working arrangements (fixed-term employment; part-time; on-call work; agency work; apprenticeship contracts; remote working; self-employment; procurement contracts).
In particular, through the Course the students will be provided with:
- legal notions, methods and legal instruments related to the sources of regulation of employment relationships in the private health care sector;
- legal notions, methods and legal instruments related to the qualification of employment relations, with specific attention to industry practices;
- legal notions, methods and legal instruments related to labour law regulations that affect the organization of work in the sector, with specific reference to work performance (job descriptions), working time, remuneration, exercise of managerial prerogatives, obligations to protect the health of the worker, management of cases of suspension of the relationship;

Expected learning outcomes
Knowledge and Comprehension: in order to satisfactorily pass the exam, the students should be able to display the knowledge and comprehension of the legal institutions and instruments which are analyzed in the Course
· Practical Skills: through the face-to-face lectures, through the individual or group presentations and through the class discussion, the students will develop their capacity to manage legal sources and relevant materials and to apply the legal rules to the practical scenarios. The mentioned capacity should be displayed by the students during the exam.
· Autonomy of Judgment: the students should display, during the exam, their individual critical positions in relation to the Course topics.
· Communication Skills: the students should display their capacity of argumentation their technical language skills in relation to the topic analyzed in the Course;
· Learning Skills: students must demonstrate that they have developed an adequate understanding of the regulation, provided by law and by collective agreements, regarding the management of work organization and of the employment relationships in the private health care sector.
