The doctoral programme "Criminal Law in Transition" aims to critically examine, using a scientific method, the regulatory changes introduced by the criminal law legislature in recent years, as well as the jurisprudential impact of these reforms in practice.
The course aims at stimulating the critical reflection of doctoral and post-doctoral students on theoretical and practical issues that, in recent years, have touched upon criminal justice systems, both in Italy and in other comparable countries in terms of legal tradition. The underlying purpose is to improve those methodological skills which are indispensable to contemporary scholars in order to address increasingly stratified and complex regulatory systems, while at the same time developing the ability to elaborate and properly argue their own insights and theses.
The first part of the course, taught in English, will consist in the analysis of wide-ranging issues relating to fundamental concepts of substantive criminal law, starting from some papers proposed as materials for the preparation of the discussions in class. The second part of the course, in Italian, will focus on the critical examination of the regulatory changes introduced by the Italian criminal legislature in recent years; as well as the jurisprudential impact that these reforms have had and will have in practice.
