Il corso mira a fornire allo studente le conoscenze necessarie ad una comprensione critica della tutela dei diritti nei diversi sistemi giuridici, con attenzione particolare alla comparazione tra le esperienze giuridiche europee e quelle latinoamericane. Esso mira altresì a collocare l'analisi di alcuni istituti del diritto privato nella dimensione della società multiculturale e quindi dei processi in atto per favorire nella tutela multilivello dei diritti una prospettiva giuridica interculturale.

Program Unit 1 for ATTENDING students
The protection of fundamental rights in Europe
A) Multilevel protection of fundamental rights in European comparative law
B) The European dynamics of protection of rights regarding religious freedom, gender inequality and multiculturalism
C) The protection of rights and the role of legal formants: comparative analysis between the Italian experience, the German experience and the French one
D) During Unit 1 students learn how to deepen their understanding of some issues: the protection of families and minors, the protection of health, the protection of privacy and personal data, the protection of consumers' food choices
Program Unit 2 for ATTENDING students
Protection of fundamental rights in Latin America
A) The democratization of the Continent and the development of national instruments for fundamental right's protection
B) The main forms of human's rights protection in Latin American constitutionalism
C) Protection of fundamental rights in the supra-regional context (Pact of San José) and sub-regional (Mercosur, Patto Andino, Unasur)
D) During Unit 2 students learn how to deepen their understanding of some issues: the protection of the person, the protection of families, the protection of the indigenous people, the protection of consumers, the 'punitive damages' and the 'multe civili' in the comparative framework of the Latin American legal systems
