Learning objectives
L'insegnamento mira a far conseguire agli studenti:
- la conoscenza delle teorie fondamentali sulla responsabilità amministrativa degli enti;
- la capacita' di vaglio critico sui criteri di ascrizione di detta responsabilità;
- la capacita' di applicazione delle conoscenze acquisite ad alcune fattispecie paradigmatiche di cc.dd. reati-presupposto.
Expected learning outcomes
Al termine del corso lo studente che abbia proficuamente appreso la materia avrà una conoscenza approfondita dei criteri di ascrizione della responsabilità 'da reati' agli enti, con l'acquisizione di un metodo di ragionamento idoneo ad affrontare con approccio specialistico il tema oltre le nozioni già acquisite con gli esami di diritto penale, diritto penale progredito e diritto processuale penale progredito.

Course syllabus
The course focuses on corporate criminal liability in the Italian legal system from under substantive criminal law perspective. The course analyses the microsystem provided for by the Legislative Decree n. 231 of 2001 (implementing the Law n. 300 of 2000), which introduced criminal liability for legal entities, corporations, and associations in the Italian legal system.
Prerequisites for admission
Having passed the exam of Criminal Law is a precondition for the course (and for taking the final examination).
Teaching methods
The course aim at providing the students with the following competencies:
- the knowledge of fundamental theories on the nature of corporate liability related to the commission of criminal offences;
- the knowledge of the basic principles of corporate criminal liability
- critical thinking skills about some of the basic elements of the Legislative Decree 231/2001;
- performing competent legal analysis with regard to relevant case-law.

By the end of the course, students who will successfully attend the course will thus have an in-depth knowledge of corporate criminal liability.
The course will enable students to develop legal reasoning skills in order to address specialized and controversial legal issues, going beyond the concepts already acquired with the courses of criminal law, criminal law - advanced, and criminal procedure advanced.
The course is taught through lectures and seminars. Attendance is compulsory.

Assessment methods and Criteria
The examination shall consist of an oral examination. It will take place as a final seminar, where the Professor, his assistants and students will engage in a final discussion on the main topics of the course. Students who will successfully take part in the final discussion will pass the exam.
