Policies and Legislation for Mountain Areas

Learning objectives
To acquire basic knowledge of the Italian legal system; to acquire fundamental tools for legal interpretation.
To acquire knowledge of the institutional actors operating in mountain areas, the rules governing them, their respective powers. To gain information about the main stages of evolution of Italian legislation concerning the mountains and about the legislation itself.
The course aims to provide information about relevant aspects of legislation regarding mountain areas and to develop methodological issues, in order to provide tools for the study and analysis of any legislation.

Legislation between state regulations, regional regulations and European Union regulations;
Constitutional framework: art. 44, co. 2, Constitution and the "measures in favor of mountain areas"; constitutional principles;
Legislation regarding mountain areas between uniformity and specificity: the different phases of state legislation, the intervention of the Regions, the contribution of the European Union;
The legislative power of the State and of the Regions for the mountains: subjects and "policies";
The government of local institutions dealing with mountain areas;
Protection of the environment, agriculture, energy, tourism.

The government of local mountain bodies;
Protection of the environment, agriculture, energy, tourism;
The mountains as a transversal priority in European programming and in the NRPR: "a greener Europe, a more connected Europe";
The experience in the Green Communities: an open construction site.
