Learning objectives
The objective of the course is to provide the student with notions of comparative law and useful knowledge in the context of productive or associative realities that work with international trade. In particular, it is proposed to introduce her/him to the complexity of national legal traditions as a prerequisite for deepening, in the second and third modules, elements relating to international trade law, specifically some of the most frequent contracts between companies, commercial practices and elements on the methods of dispute resolution.
Expected learning outcomes
The student will have a historical-comparative overview of the main European and non-European legal traditions, which will allow her/him to formulate independent judgments on them and to critically approach her/his own national legal system. Furthermore, she/he will be able to understand the dynamism and complexity of the discipline of international contracts and, in particular, of the contract for the sale of goods. She/He will know the main commercial terms used in the sale and will acquire elements to understand the dynamics of the resolution of international disputes through commercial arbitration.

I - Introduction to legal comparison. Elements of systemology: the main legal traditions: civil law, common law, Asian and religious systems.
II - The international contract. Sources. The main relevant typologies in international trade and related discipline.
III - International sales and Incoterms®. Dispute resolution and international commercial arbitration.
Prerequisites for admission
Fundamentals of private and international law.
Teaching methods
The course includes lectures in Italian and possible seminars with guests, and is characterized by the active involvement of the students, thanks to constant comparisons and moments dedicated to sharing the main topics addressed, also through case studies and group work.

Assessment methods and Criteria
The final exam is oral, with a vote expressed by the 30-point scale (18 to 30 cum laude). The knowledge of the program, the property of the language, and the ability to make comparative and/or critical evaluations regarding what has been learned will be evaluated. There is an optional mid-term exam in written form; in case of participation, the final evaluation will be the average of the two votes.
