Learning objectives
The course aims to provide students with:
- a good knowledge of the basic principles of civil execution and insolvency law, also in connection with the underlying institutions and principles of private law, commercial law and civil procedural law;
- a literal as well as systematic understanding of legislative texts;
- the ability to coherently present the topics studied using an appropriate language;
- the ability to reason on interpretative issues and apply theoretical notions to real-life cases.

Course syllabus
The course covers the principles of individual enforcement and insolvency proceedings.
The individual enforcement process in general. Preparatory acts of the enforcement proceedings. Enforced expropriation. Execution in specific form. Opposition to enforcement by the debtor or by the third party. Opposition to enforcement acts. Suspension and extinction of the enforcement process.
Crisis regulation procedures in general. The objectives of crisis regulation procedures. The so-called negotiated procedures and the so-called judicial procedures. Subjective and objective prerequisites. Effects. Individual procedures. Judicial liquidation. The arrangement with creditors. Debt restructuring agreements. The negotiated crisis resolution. The other restructuring instruments.

Prerequisites for admission
The following subjects are propaedeutic: Institutions of Private Law, Constitutional Law, Commercial Law and Institutions of Civil and Criminal Procedure Law.

Assessment methods and Criteria
The examination consists of an oral interview in order to verify the achievement of the objectives. The assessment is expressed in thirtieths, with honours where appropriate.
The assessment criteria take into account the correctness of the content, clarity of argumentation, appropriate language and critical analysis skills.
Since there are two subjects covered (individual enforcement and insolvency law: chek the program), it is necessary to demonstrate sufficient knowledge of both to pass the exam.
