Environment, Climate and Energy: Regulatory Strategies

Learning objectives
The course aims to provide students with an overall understanding of the legal instruments that shape the European Union's climate and energy policy from the perspective of the European Union's international commitments and their impact on the domestic legal systems of Member States.
The course places particular emphasis on instruments that innovatively promote climate and energy policy objectives by employing precise regulatory strategies that affect broad sectors of the European Union's actions in terms of both its internal policy and international relations. Teaching will focus on new ways of understanding "sustainability", in particular as a criterion for distinguishing and selecting "environmentally sustainable activities" and "environmentally unsustainable activities" in a competitive market.

Expected learning outcomes
Upon completing the course, students will understand the role of regulation in achieving sustainability objectives and will have knowledge of the regulatory framework for environmental protection and how it serves as a "legal asset" through which the European Union delivers its environmental and energy policy. Students will be able to identify the strategic elements of Union policy, its relationship with the relevant instruments of international law and the effects of the European Union's actions on national laws. Students will also understand the concept of "sustainability" and the implications of applying it to economic activity in a competitive market.
By taking part in classroom activities, students will also develop the ability to independently analyse and assess the European Union's making of environmental and energy law, including regulations different from those examined during the course, to prepare them for their future studies and careers.

Course syllabus
During the course, the teacher will mainly address the following topics:
- general principles on the regulation and evolution of regulatory strategies, with particular reference to environmental, energy and climate sustainability;
- sources of environmental law;
- the 'governance' of the environment;
- private participation in public environmental decisions;
- the impact of environmental, energy and climate sustainability on finance: goals, instruments and critical issues.

Prerequisites for admission
No particular skills are required.
Teaching methods
The teacher will use lectures. To make it easier to understand the topics covered, the teacher will use slides on individual issues and will deepen some arguments with an examination of case law and sectoral cases.

Assessment methods and Criteria
The examination takes place in written form and is aimed at verifying the acquisition of knowledge, the understanding of the subjects of the course and the communication skills through the appropriateness and adequacy of the language used. The test will be divided into open-ended questions, so to assess the knowledge acquired, the autonomy of judgment acquired also in reconstructing the arguments and the legal problems underlying them.
Attending students will have different questions from not attending ones.
For attending students the questions will refer to the parts of the texts indicated in the program and to the issues discussed in class. Intermediate tests are provided to attending students during the course, to verify and improve their ability to learn.
The questions for not attending students will refer to the parts of the texts indicated in the program.
The final vote will be expressed in 30th.
